Terms of Service & AI Use

Rules for using Super Athlete’s global platform, licensed AI identities, digital products, and paid services. Effective September 30, 2026.

Please read these Terms carefully. They include important rules about AI-generated content, authorized voice and likeness use, payments, risk, and your legal rights. Nothing in these Terms limits rights that cannot lawfully be waived.

    1. Agreement and operator

These Terms of Service are a binding agreement between you and NextGenTM, Inc., doing business as Super Athlete and LootMogul (collectively, “Super Athlete,” “we,” “us,” or “our”). They govern superathlete.ai, our applications, AI Academies, AI Clubs, AI podcasts, licensed AI identity experiences, digital products, and related services (the “Services”).

NextGenTM, Inc. is located at 831 N Tatnall Street, Suite M #275, Wilmington, DE 19801, United States. By accessing or using the Services, you accept these Terms and our Privacy & AI Rights Center. Product, checkout, athlete, club, partner, or licensing terms also apply where presented; if they conflict, the more specific terms control for that product or relationship.

    2. Eligibility, accounts, and security

You must be at least 18 years old and legally able to enter a contract to create an account or use a paid or interactive Service. The Services are not directed to children. Uses involving a minor require separate written authorization from an authorized parent, guardian, school, league, or other rights holder and are not available through self-service registration.

You must provide accurate information, safeguard your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless prohibited by law. We may require identity, authority, age, payment, or rights verification before providing or continuing a Service.

    3. Licensed AI identities, voice, and likeness

Some Services use authorized voice, image, likeness, biography, knowledge, or performance material to create synthetic or AI-assisted experiences. An AI response, voice, image, or video is generated content and is not necessarily a new statement, endorsement, or live interaction by the depicted person.

You may not upload, clone, imitate, generate, publish, or commercialize another person’s voice, likeness, identity, signature, or protected material unless you have documented authority covering that use. Rights owners retain the rights stated in their agreements and applicable law. Authorizations are purpose-specific; permission for one channel does not grant permission for another. Requests to pause, revoke, or remove an authorized identity are handled under the governing agreement and applicable law.

    4. AI use and output limitations

AI outputs may be incomplete, inaccurate, offensive, outdated, or unsuitable for your circumstances. You must independently evaluate outputs before relying on, sharing, or acting on them. The Services do not provide medical, mental-health, legal, financial, recruiting, eligibility, safety, or other professional advice and do not guarantee athletic performance, selection, earnings, or results.

You may not use the Services to deceive, impersonate, harass, exploit, discriminate, facilitate unlawful surveillance, make high-impact decisions without appropriate human review, bypass safety controls, extract models or source material, conduct unauthorized model training, or create unlawful or harmful content. Do not submit confidential, regulated, or third-party personal information unless you are authorized and the feature is intended for it.

    5. Content, intellectual property, and feedback

The Services, software, designs, brands, models, compilations, and platform content are owned by or licensed to NextGenTM, Inc. Except for the limited right to use the Services under these Terms, no rights are transferred to you. Athletes and other identity owners retain their voice, likeness, name, and personal-brand rights as provided by law and contract.

You retain rights you hold in content you submit. You grant us a worldwide, non-exclusive, limited license to host, process, reproduce, adapt, and display it only as needed to operate, secure, improve, and provide the requested Services, comply with law, and enforce these Terms. You represent that you have all necessary rights and permissions. Feedback may be used without restriction or compensation, but we will not identify you publicly without permission.

    6. Purchases, subscriptions, delivery, and refunds

Prices, currencies, taxes, billing intervals, renewal terms, access periods, delivery method, cancellation rights, and refund terms are shown at checkout or in product-specific terms. You authorize our payment processor to charge the payment method you provide. Subscriptions renew until canceled as disclosed at purchase; cancellation normally prevents future renewal and does not retroactively refund a completed period unless stated otherwise or required by law.

Digital access is granted only after verified payment and may take time to confirm. A checkout return page alone does not prove payment or create entitlement. Chargebacks, reversals, fraud, refunds, or payment failure may suspend or revoke related access. Statutory consumer rights remain unaffected.

    7. AI Tokens and promotional value

AI Tokens are closed-loop platform credits used for eligible interactions. They are non-transferable, non-withdrawable, not legal tender, have no cash value except where law requires otherwise, and are not securities or investments. Token prices, usage rates, expiration, promotional conditions, and refund treatment may vary by offer and are disclosed where applicable.

    8. Third-party services and global availability

The Services may depend on payment, hosting, analytics, communications, content, AI, voice, video, social, and other providers. Their terms and privacy practices may apply when you use their features or follow their links. We are not responsible for third-party services outside our control.

You may use the Services only where lawful. You must comply with applicable export controls, sanctions, anti-corruption, consumer, publicity, intellectual-property, sports-governance, and data-protection laws. Features, languages, prices, and availability may differ by country and may change to meet legal, safety, licensing, or provider requirements.

    9. Enforcement, suspension, and termination

We may investigate suspected misuse and restrict, suspend, or terminate access when reasonably necessary to protect people, rights, the Services, or third parties; respond to legal process; prevent fraud or security harm; or enforce these Terms. We may preserve relevant records as permitted by law. You may stop using the Services at any time and may request account deletion through the Privacy & AI Rights Center.

Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, limitations, indemnity, and dispute provisions—will survive.

    10. Disclaimers, liability, and indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, CONTINUITY, OR RESULTS. WE DO NOT WARRANT THAT AI OUTPUTS OR THIRD-PARTY SERVICES WILL BE ERROR-FREE, SECURE, OR AVAILABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTGENTM, INC. AND ITS AFFILIATES, LICENSORS, IDENTITY OWNERS, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES. OUR AGGREGATE LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR THE AFFECTED SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so they apply only to the extent lawful.

To the extent permitted by law, you will defend, indemnify, and hold the covered parties harmless from claims arising from your unlawful use, your content, your violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

    11. Changes, disputes, and general terms

We may update these Terms to reflect new products, laws, risks, or business practices. We will post the revised date and provide additional notice where required. Material changes apply prospectively unless law permits otherwise. Continued use after the effective date means you accept the updated Terms.

Before filing a formal claim, contact legal@nextgentm.com so we can attempt to resolve it informally. These Terms do not create third-party beneficiary rights. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or asset transfer.
